Frequently Asked Questions

I was in an automobile accident, what do I do now?

Most importantly, do not leave the scene of the accident. Leaving an accident is a criminal offense.

After the collision has occurred, take notes. If you can take photos of the scene, that is also helpful. It is easy to forget what happened days after the traumatic event and your understanding of what happened may change. Be as thorough as you can with your notes. Even the smallest detail can change the outcome of any case.

Take down everyone’s names involved in the accident and insurance information. If possible, you should also file a police report. Be aware of your injuries. You may not experience them until days later, but take notes on how you feel and where it hurts. Injuries also include emotional distresses or anxiety, which can be included in compensation.

Do I need a lawyer?

Having an attorney handle your claim will likely award to you more money. It also relieves the stresses of coping with insurance companies on your own. The Car Accident Attorney Offices works for you to get you the best compensation available.

If you suffered a serious injury that required surgery, left scars, broke bones or especially caused brain damage, it is essential to have an attorney. Your affliction may entitle you to punitive damage compensation as well as medical expenses reimbursement. It is also wise to hire a lawyer if criminal activity was involved in your accident, i.e. hit and run, DUI, reckless behavior or any other violation of the law.

If you were in an accident and want your damages covered to the fullest extent, having a member of Car Accident Attorney Offices on your side just makes sense.

What will my insurance cover?

This will be dependent on your insurance provider and the level of coverage that you possess. But insurance can cover some if not all of the following:

  • Your medical payments
  • Your vehicle’s physical damage
  • The other car’s people’s injuries and vehicle damage
  • The cost to rent a vehicle while yours is being repaired

Again, it is dependent on the insurance that you have. We will be happy to help decipher your policy with you and figure out what your plan covers.

What if I do not have insurance?

If you do not have insurance and you were not at fault for the accident, it is possible to make a claim and you may be entitled to damages. This is made easier and more possibly by hiring an attorney to handle your claim. However, driving without insurance is against the law, so even though your damages may be covered, you could still lose your license and/or not receive full compensation.

If you do not have insurance and you are at fault, it is likely that you will need to pay all expenses out-of-pocket. Medical expenses and vehicle damage for the other driver can be extremely expensive, but having a lawyer on your side could decrease the amount that you would have to pay.

What if the other driver has no insurance, or not enough to cover my damages? If the other driver does not have enough insurance, you will receive the maximum amount provided from his/her insurance and the remaining expenses can be covered by your own underinsured motorist coverage. If you do not have underinsured motorist coverage, then it is possible to be compensated from his/her assets, but it is unlikely that there will be any.

How much money will I be awarded?

You will be awarded either what the insurance company finds suitable for your accident, or what a judge recommends. Each case varies depending on the situation and the severity of the injuries. It is possible to be covered for money lost from past and future medical bills; past and future wage loss; and pain and suffering. If you lost a loved one in the accident, you are also eligible for punitive damages, which can lead to a higher dollar amount.

Do I need to be seriously injured to file a lawsuit?

You do not need to be seriously injured to file a lawsuit. It is likely that an attorney can get you more compensation than what the insurance companies are awarding, no matter your injuries. However, having an attorney is essential when you are seriously injured because you may not receive enough reparation to make up for your suffering by filing claims alone.

How much will my case cost?

One of the best things about The Car Accident Attorney Offices is that we advance all costs and expenses of prosecuting your case. Our cases are all done on a contingency fee basis, which means that you do not pay us anything until our lawyers collect for you. As long as you follow the instructions given to you by one of our attorneys, the financial responsibility of the case remains with us.

If we do not collect, you do not owe us a fee.

Will I pay more if my case goes to trial?

Attorney fees increase when a case goes to trial; however, there will still be no money out-of-pocket for you as we will receive the additional fees when we collect the settlement. But once again, if we do not collect, you do not owe us any fee.
